Terms of Use

These terms are an agreement between you and MBS Desk (“we”, “us”, and “our”). They cover everything at mbsdesk.com.au: the MBS Desk tool, our blog and guides, your account, and any paid plan (together, “MBS Desk”). Our Privacy Policy and Disclaimer form part of these terms.

By using MBS Desk, creating an account, or paying for a plan, you agree to these terms. If you don’t agree, please don’t use MBS Desk. If you use MBS Desk for a practice or another organisation, you confirm that you’re allowed to agree for it, and “you” includes it.

1. What MBS Desk is, and isn’t

MBS Desk is an information tool for billing under the Medicare Benefits Schedule (MBS). You describe a consult, and it suggests MBS items the consult may be eligible for, items you may have missed, requirements to check, and the MBS text each one comes from.

MBS Desk gives general information, not advice. It doesn’t give billing, coding, compliance, legal, financial, tax, or clinical advice, and its suggestions aren’t a recommendation to claim any item. Using it doesn’t create a professional or advisory relationship between you and us.

MBS Desk is for billing and claims administration only. It isn’t intended to diagnose, screen for, prevent, monitor, predict, treat, or alleviate any disease, injury, or condition, or to recommend or decide on any treatment, and it doesn’t replace your clinical judgement. When MBS Desk says a patient may be eligible for a service, such as a health assessment, that’s about what the MBS allows, not a recommendation that the patient needs it.

MBS Desk works only from what you enter and its own copy of the MBS. It doesn’t connect to Medicare, see a patient’s claims history, or lodge claims, so it can’t know, for example, whether a patient has already had a service that limits what you can claim.

MBS Desk is independent. It isn’t affiliated with, endorsed by, or acting for Services Australia, Medicare, the Department of Health, Disability and Ageing, the Professional Services Review, or any other government body.

2. Who can use MBS Desk

The MBS Desk tool is for health professionals and practice staff in Australia, such as general practitioners, GP registrars, nurse practitioners, practice managers, and billing staff, to use in their work. You must be at least 18.

Anyone can read our blog and guides.

3. The claim is yours

You decide what to claim. You’re solely responsible for every claim made for your services, whether you lodge it yourself or someone else lodges it for you, including making sure that:

  • each service meets every requirement of the MBS item claimed and of the law;
  • your clinical records support each claim; and
  • the patient is eligible, and any limit on how often an item can be claimed is met.

Before you claim, check each item against the current MBS on MBS Online, including its explanatory notes, and any guidance from Services Australia or the Department. If you’re unsure how an item applies, ask AskMBS or a qualified adviser.

To the extent the law allows, we aren’t responsible for any audit, compliance check, Professional Services Review, investigation, debt, recovery or repayment of benefits, administrative penalty, interest, or other consequence of a claim you make, or for income you miss because MBS Desk didn’t suggest an item.

4. Accuracy and AI

MBS Desk uses automated systems, including artificial intelligence (AI), to read what you enter and to write its replies. Its results can be incomplete, out of date, or wrong. For example, it may misread your notes, miss an item that applies, suggest one that doesn’t, apply a rule wrongly, or show the wrong fee.

The MBS changes often. We update MBS Desk from official MBS releases, but there can be a delay, and the official MBS and the law always prevail over anything MBS Desk shows.

Fees shown are MBS schedule fees and benefits, as a guide only. What’s actually paid depends on the patient, how the service is billed, safety nets, incentives, and other things MBS Desk may not know.

The same notes may not always give the same result, and results change as we improve MBS Desk.

We don’t guarantee that MBS Desk, or anything it shows, is accurate, complete, or current, that it will find every item you could claim, or that it suits your purposes. Check every result before you rely on it.

5. Patient information

Enter de-identified information only. Don’t enter anything that identifies a patient or anyone else, or that could reasonably be used to identify them, such as a name, date of birth, address, phone number, email address, Medicare, DVA, or Individual Healthcare Identifier number, record number, or a mix of details rare enough to point to one person.

You’re responsible for making sure that what you enter is de-identified, that you’re allowed to use it in MBS Desk, and that your use of MBS Desk complies with privacy law, your professional obligations (including Ahpra and National Board guidance on using AI), and your practice’s policies.

Any automatic checks we run for identifiers are basic. They don’t catch everything, and they don’t change your responsibility. If you enter identifying information by mistake, email us at admin@mbsdesk.com.au and we’ll delete it from our records where we can find it.

6. Your account

Some features may need an account. Give us accurate details and keep them up to date.

Keep your sign-in details secure and don’t share them: each account is for one person. Tell us straight away if you think someone else has used your account. You’re responsible for what happens under your account, unless it happens because we didn’t take reasonable care.

7. Paid plans

Some features may need a paid plan. Before you pay, we show you the price, what it includes, the billing period, that it renews automatically, and how to cancel.

Payments are processed by Stripe, our payment provider. We don’t see or store your full card details.

Plans are paid in advance and renew automatically at the end of each billing period, at the price that applies then, until you cancel. Before a yearly plan renews, we’ll email you a reminder.

If a plan starts with a free trial, we’ll tell you before you start when the trial ends and what you’ll be charged after it. Unless you cancel before the trial ends, your paid plan starts when it does.

Prices are in Australian dollars and include GST where it applies.

You can cancel at any time, from your account or by emailing us. Your plan stays active until the end of the period you’ve paid for, and doesn’t renew after that.

We don’t give refunds if you change your mind, including for part of a billing period. That doesn’t affect the refunds these terms promise, or your rights under the Australian Consumer Law.

We may change our prices. We’ll email you at least 30 days before a new price applies to you, and you can cancel before it does.

If a payment fails, we may pause your paid features until it’s made.

8. Using MBS Desk fairly

You must not:

  • use MBS Desk for anything unlawful, or to make or support a claim you know or suspect is false, misleading, or not supported by your records;
  • enter identifying information about patients or anyone else (see Patient information);
  • copy, scrape, or bulk-download MBS Desk’s content or results, or use bots or scripts to reach it, other than search engines and AI search tools that follow our robots.txt file;
  • use MBS Desk or its results to build, train, or improve a competing product or an AI model;
  • reverse engineer MBS Desk, or try to extract its source code, prompts, data, or models, except as the law allows;
  • try to make MBS Desk ignore its instructions or produce content unrelated to its purpose;
  • test or break our security, overload our systems, or get around any limit or access control;
  • share, resell, or sublicense your access, or let anyone else use your account; or
  • present MBS Desk’s results as advice from us, or from Medicare or any other government body.

9. Our content

We, or those we license from, own MBS Desk and everything in it, including its software, design, text, data, and blog posts. That doesn’t include MBS material or your content.

As long as you follow these terms, you may use MBS Desk and its results in your own work, including keeping results in your records and sharing them within your practice. You may link to our pages and quote short extracts from our blog with a link back to the source. Please don’t republish whole pages or posts without our permission.

MBS Desk includes material from the Medicare Benefits Schedule, which is © Commonwealth of Australia (see MBS material in our Disclaimer).

10. Your content and feedback

You keep ownership of what you enter. You give us permission, free of charge, to store, copy, and use it to run, secure, and improve MBS Desk, as our Privacy Policy explains, including by sending it to the providers that help us run MBS Desk. This permission lasts as long as we keep your content.

You confirm that you’re allowed to enter your content, and that our using it as these terms allow won’t break any law or anyone’s rights.

If you send us feedback or ideas, we may use them freely, without paying you.

11. Our blog and guides

Our blog, guides, examples, and other website content are general information only. They don’t take your circumstances into account, they aren’t advice, and the MBS may have changed since they were written. Examples are for illustration only and don’t describe real patients. Check the current MBS, and get advice where you need it, before acting on anything you read.

13. Changes to MBS Desk

We work to keep MBS Desk available and up to date, but we don’t promise that it will always be available, uninterrupted, or error-free, and we may pause it for maintenance.

We may change, add, or remove features. If a change significantly reduces what your paid plan includes, you can cancel, and we’ll refund the unused part of your current billing period.

If we stop offering MBS Desk, we’ll give paying users at least 30 days’ notice where we reasonably can, and refund any fees paid for the time after it stops.

14. Suspending or ending your use

You can stop using MBS Desk at any time, and you can close your account by emailing us.

We may suspend or end your access if you seriously or repeatedly breach these terms, if a payment isn’t made, if the law requires it, or if your use puts MBS Desk, other users, patients, or anyone else at risk. Where it’s reasonable, we’ll tell you first and give you a chance to fix the problem.

We may also end your access for any other reason by giving you at least 30 days’ notice, and we’ll refund any fees paid for the time after it ends.

The parts of these terms that are meant to continue after your use ends will continue, including The claim is yours, Your content and feedback, Limits on our liability, and Your indemnity.

15. Your rights under the Australian Consumer Law

Our services come with guarantees that can’t be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts, or changes any right or remedy, or any guarantee, warranty, or other term, that the law says can’t be excluded, restricted, or changed.

MBS Desk isn’t a service of a kind ordinarily acquired for personal, domestic, or household use. So, to the extent the law allows, if we fail to meet a consumer guarantee, our liability is limited to, at our choice, supplying the services again or paying the cost of having them supplied again.

16. Limits on our liability

To the extent the law allows, and subject to your rights under the Australian Consumer Law, the following applies however our liability arises, whether in contract, in negligence or another tort, under a statute, or otherwise:

  • MBS Desk is provided “as is” and “as available”, and we make no promises about it, its content, or its results beyond those in these terms;
  • we aren’t liable for any indirect or consequential loss, or for any of these: lost income, revenue, profit, or billing opportunities; amounts you must repay to Medicare, an insurer, or a patient; debts, penalties, fines, or interest; the cost of responding to an audit, review, investigation, or dispute, including legal and accounting fees; lost or corrupted data; or harm to your reputation or goodwill; and
  • our total liability to you for everything connected with MBS Desk or these terms is limited to the greater of the fees you paid us in the 12 months before the event that caused the loss, and A$100.

Our liability is reduced to the extent that you, or anyone acting for you, caused or contributed to the loss, including by not checking a result as these terms require.

Nothing in these terms limits our liability for fraud or wilful misconduct, or any liability that the law doesn’t allow us to limit.

17. Your indemnity

You indemnify us against any loss, liability, or reasonable cost (including reasonable legal costs) that we suffer because someone else, such as a patient or a regulator, makes a claim or takes action against us arising from:

  • claims made for your services;
  • your breach of these terms, including entering identifying information; or
  • your breach of the law or of your professional obligations.

This doesn’t apply to the extent that the loss was caused by our breach of these terms, our negligence, or our wilful misconduct.

18. Changes to these terms

We may update these terms, for example to reflect changes to MBS Desk, to the law, or to how we run MBS Desk. We’ll post the new terms on this page with a new date.

If you have a paid plan and a change materially reduces your rights or adds to your obligations, we’ll email you at least 30 days before it takes effect. If you don’t accept the change, you can cancel before then, and we’ll refund any fees you’ve paid for the time after it takes effect.

Other changes take effect when we post them. If you keep using MBS Desk after a change takes effect, the new terms apply to you.

19. Disputes and governing law

If something goes wrong, please email us first. We’ll both try in good faith to sort it out within 30 days before going to court, unless someone needs urgent relief from a court.

These terms are governed by the laws in force in Queensland, Australia. You and we accept the non-exclusive jurisdiction of the courts of Queensland, and of the courts that can hear appeals from them.

20. General

  • If any part of these terms can’t be enforced, it’s limited or removed only as far as needed, and the rest still applies.
  • If we don’t enforce a right straight away, we haven’t given it up.
  • You can’t transfer your rights under these terms without our written consent. We may transfer ours to whoever takes over MBS Desk (for example, a company set up to run it), as long as we tell you and your rights aren’t reduced.
  • Neither you nor we are responsible for a delay or failure caused by events beyond our reasonable control.
  • These terms, with our Privacy Policy and Disclaimer, are the whole agreement between you and us about MBS Desk.
  • In these terms, “including” and “for example” don’t limit what comes before them.
